        What are the needs? what is the diagnosis you all are pushing for?

          Did you see the application that the parents made? It may be that they did not include enough supporting evidence. Also, there should be a reason given for the refusal. It is not that unusual for EHCP applications to be refused initially – it has happened to me twice. Both times I fought the decision and had them overturned. If you feel that the child needs an EHCP then don’t give up.

            Ok there’s two legal tests

            1) the child may have special needs
            2) those needs may require a plan to be met

            Without assessing how do you make a judgement on that?

            That’s why 9/10 appeals are won!
