To reply with a no offer to a consultation, you have to adhere to the legally allowed reasons, so it depends how water-tight the evidence was for the student not to attend. Parental choice is very high tariff in the law so LAs will always try and follow that. If you have been named even with a no offer, if I were you, I would start with a meeting with the LA and the family, have an open discussion about the reality of the situation. If you are very strong on your evidence and think it will not work, then you would have to step up to a tribunal.
