The Mediation provider should start the mediation, regardless of the LA’s approach to the process, and record the lack of participation of the LA so this can be exhibited at FTT.
Person with parental responsibility should instigate a judicial review in respect of the LA’s lack of engagement in a statutory appeal mechanism.
There is no other recourse against the LA for not engaging in mediation due to badly written legislation.
