I would suggest this is not lawful grounds for a refusal and that you encourage the parent to register for both mediation and tribunal. They must register for tribunal within 2 months of the date of the refusal to assess letter. In my experience once the LA know you have a solid case and some one on panel wrongfully refused the assessment application they generally fold before they would go to Tribunal – encourage parent to get SENDIASS on side to support them too.
